Discussion paper - changes to the Child Protection Act 1999

The Department of Child Safety, Youth and Women is seeking feedback on options for changes to the Child Protection Act 1999.

Following a review of the Act between 2015 and 2017, and some priority amendments being made in 2017, we are now considering further changes to the legislation to continue building a strong, modern legislative framework.

The changes proposed for the next stage focus on:

  • reinforcing children’s  rights in the legislative framework
  • strengthening children’s voices in decisions that affect them
  • reshaping the regulation of care.

A discussion paper, Rethinking rights and regulation: towards a stronger framework for protecting children and supporting families, has been developed, outlining a number of options for changes to the legislation in the three focus areas.

We are seeking your views on the options proposed in the paper and any other issues you may like to raise regarding reinforcing human rights in the legislative framework, strengthening children’s voice in decisions and reshaping the regulation of care.

The options for changes to the legislation are independent of the others—one, some or all of the options in each focus area could be implemented.

By getting involved and having your say you will be part of the process for changing the Act—your views will help us decide what changes should be made.
